Your business, your responsibility
You are an independent business and the seller of record for your food. You are responsible for food safety, accurate menus, prices and allergen information, and for holding and keeping current every permit and license your food and locations require. You agree to follow the food rules for your state, county and city, and to re-acknowledge them when they change.
Home-based food
If you sell under a cottage-food or similar home-based program, sell only the foods that program permits. Follow its labeling, sales, pickup and delivery rules. Foods requiring a licensed operation must be prepared and sold through that operation. Check the food regulator for each state and locality where you operate; a Fork & Curb subscription does not replace a permit.
Payments and payouts
Customer payments are processed by Stripe and paid out to your connected Stripe account. Fork & Curbβs fees are those shown on the Pricing page and in your plan at the time of the order, and are deducted as an application fee. Tips on pickup orders are yours; tips on deliveries go 100% to the driver.
Refunds and chargebacks
If you cancel an order you cannot fulfill, the customer is refunded in full, your payout for that order is reversed, and you bear the non-refundable card-processing cost; Fork & Curb returns its own fees. Food-quality problems are your responsibility. Delivery problems are claimed from the delivery provider. Errors caused by Fork & Curb are absorbed by Fork & Curb. You authorize Fork & Curb to reverse transfers from your connected account to cover refunds and chargebacks on your orders.
Location and availability
Only mark yourself open at the place you are actually serving. Keep your menu and sold-out items current, and use Pause when you canβt take orders.
Customer relationships
Customers who follow you and opt in are your customers. Message them only with their consent, honor STOP and quiet hours, and follow text-messaging laws.
Insurance
Maintain insurance appropriate to your business. Follow the insurance and certificate requirements stated by each venue before using its spaces.
Suspension and termination
Expired permits, food-safety reports, fraud and violations of this agreement are grounds to pause or remove a listing. Contact support to resolve a restriction or close your business account. Outstanding orders, refunds and payment obligations remain your responsibility.
Pickup and delivery responsibilities
Choose the delivery services your business accepts and keep pickup instructions current as your stop changes. Your own drivers remain your responsibility, including their authority to drive, insurance and safe handling. Using your own drivers does not create a third-party courier charge from Fork & Curb.
Third-party delivery charges and the Fork & Curb delivery charge are included in the delivery total presented for the order. Do not promise an unassigned courier or a delivery time that the order has not confirmed. Package food securely and hand off the correct order.
Team access and customer information
Give each team member only the access needed for their work and remove access when they leave. Use order contact and address details to fulfill the order and resolve issues, not to send unsolicited marketing. Keep personal customer details out of public menus, photos and posts.
Plans, charges and records
Review the plan and payment summary before agreeing to a subscription or charge. Keep your own records of sales, expenses, tax and refunds. Dashboard insights assist your business; they do not replace bookkeeping or tax responsibilities.
Changes to a plan do not erase outstanding refunds, disputes or other amounts already owed. Contact support with the order or subscription reference when you dispute a charge.
